HSSD bosses in dismissal cover-up
MANAGERS at the Health and Social Services Department unfairly sacked one of their staff - and are trying to cover up their actions.
This emerged after the department decided at the last moment not to contest an industrial tribunal hearing brought by the dismissed employee.
Brian McDonald, whose role at the department has not been disclosed, was dismissed last year and the HSSD was initially prepared to dispute his claim.
However, on the day of the hearing, department officials struck a deal with Mr McDonald immediately before the panel could start to hear the evidence and adjudicate on his complaint.
Those discussions centred on how much money Mr McDonald should receive for being unfairly dismissed and, although that is paid for by the taxpayer, the department has taken legal steps to prevent disclosure of the matter.
Asked for details by the Guernsey Press, a HSSD spokesman said that a confidentiality clause was included in the settlement with Mr McDonald ‘which means that neither ourselves or Mr McDonald are allowed to disclose any details whatsoever,’ he said.

mmm I find it strange that Deputy Adams had no knowledge of someone taking the Department to the industrial board..

It is quite strange, the number of tribunals that HSSD (and SoG in general) get taken to lately and settle before hand or lose when they go through with it. Someone once told me that the cost of setting up a tribunal was in excess of £70k. Maybe those in the management positions who decide on going as far as tribunal should have some HR training, as should those who cause the problems in the first place.

Mr McDonald’s payout was based on what a member of
management said to him, it hurt his feelings poor man
Looks like Mr McDonald and his HUSBAND Andres have enough money
now to fly back to either Andres’s native country Brazil or McDonald could go
back home to Canada...all at our expense.
McDonald is a uppity man who thinks the world owes him a favour and its
his right to shout and scream like a little girl and if you say anything to him
he throws the Gay card in your face and claims you victimizing him because he's
gay.

What department did he work in, doing what job?
Seems strange to say the payout was for hurt feelings when the case was for unfair dismissal.

I find it truly amazing that the department backed out at the last minute . As for the Minister to say " I was unaware of the case because, he said, of the large number of staff it employs".is just a feeble excuse , the trouble is there is no accountability whatsoever IMO there should be an inquiry to find out what really went on. Do not forget it is tax payers money they are throwing away.

This is nothing short of a disgrace, if a minister isn't aware of potential legal proceedings involving his department what on earth is he aware of?

No matter how 'uppity' someone is, if they were dismissed unfairly then they were dismissed unfairly. The fact that a States dept had to do a deal to close the door without embarassment says alot about how things are run here. Adam's quote is scandalous. The States are a shambles, they have learned nothing from the last few years. If you are incompetent then at least be honest instead of releasing pathetic statements saying "it wasn't me".

he? This individual shouts and screams worse than Alan Carr, tries to put words
into your mouth. So yeah I would of written like this regardless of them being
gay or not. And just to set the record straight (no pun intended) I have
nothing against gays some of my best DVDs are full of lesbians.
