Mistakes were made in the way Jersey's former Police Chief was suspended.

An independent report highlights several failings in the procedure followed in the run-up to Graham Power's exclusion from office.

But the report has concluded there was no plot to oust the police chief and there is no need for a further inquiry.

The Chief Minister has issued the report received from Brian Napier QC, who was commissioned to review the suspension process.

The Chief Minister ordered the report after Deputy Bob Hill called for a full-blown Committee of Inquiry into the suspension.

Mr Napier is a Scottish advocate who specialises in Employment Law. He was selected by the Chief Minister and Deputy Bob Hill, from a list of specialists provided by ACAS

The report was commissioned in March 2010, but due to delays in arranging interviews with those involved and Mr Napier’s other work commitments, it was not possible to complete the review in the original timescale. The final report was received on 13 September.

When the Chief Minister reviewed the report and conclusions reached by Mr Napier he felt advice was required before the report could be published.

Senator Terry Le Sueur said: 'I regret that it has taken longer than I originally envisaged to complete the report. I hope, now it has been published in its entirety, both States Members and the public will see that it is thorough and reaches a number of conclusions.

'Mr Napier was asked to examine the suspension procedure and to judge whether or not a Committee of Enquiry into the suspension of Mr Power was justified. Mr Napier concludes that his findings do not warrant a further inquiry in the interests of open government; and he states I do not see a need to investigate these matters further'.

Senator Le Sueur added 'While he has highlighted procedural failings in the suspension process, Mr Napier found no evidence of a ‘conspiracy’ to oust Mr Power for some improper reason and I hope this allegation can now be put to rest.

'I have taken advice on all the conclusions and will be acting on that advice in the coming weeks. As was the case throughout Mr Power’s suspension, I intend to maintain confidentiality on this matter, and will ensure any individuals involved are treated with respect.

'“I will not be making any further statement on the conclusions of the report until all internal matters have been concluded.'

The States of Jersey Police Chief Graham Power (Queens medal holder ) was suspended because of so called failings in the expensive Haut de la Garenne enquiry.

The interim Metro police report was cited as being the document that added weight to the suspension. The Napier report looks at the suspension, was it carried out correctly and the conduct of those involved, was it a conspiracy ?

Who better to comment on Mr Napier QC findings than the Police chief retired Mr G. Power, and other local commentators whom are very well informed, having studied the case at the top of Jersey society and pulling in the Attorney General, solicitor general and leading heavy weight politicians as the people making the decisions which led to the suspension.

Had Mr. Napier done so – he would have realised the so-called “interim Met report” – which is still cited, as though it were a valid criticism of the original abuse investigation – is now actually so utterly discredited itself – its author is now subject to Misconduct proceedings.

This is top Government in Jersey, but is it fair un-corrupted Government read more.

Mr Napier QC, commissioned author of a the report into the suspension of Jerseys police chief , is unusually not interested in returning to Jersey to hold an open question and answer meeting regarding his report (work) into the suspension of Chief of Police Graham Power retired.

See the response from CP Graham Power and his deputy Lenny Harper also retired. It makes interesting reading but also opens yet more revealing insights in to the way The Chief Minister and Chief executive of the States of Jersey seem to have lost sight of reality. The remit or terms of reference ( TOR ) for the report where changed apparently at the last moment ?

The episode of "Yes Minister", entitled "The Greasy Pole", is particularly instructive with regard to the Napier report.


But there is clear evidence that (1) proceedings for suspension were proceeding apace, in secret; (2) there was clearly a private collusion between Mr Ogley and Mr Warcup; (3) while the "highest level of the administration", and that could possibly include Chief Minister Frank Walker took no direct part in this, they were most probably aware of this, and had no objections to it - which might be construed as deniability.

Mr Power confirmed in interview that he saw Jersey society as characterised by a lack of integrity and a dislike for openness in government. He described Jersey culture as being one where things are kept secret unless someone can force you to tell it, and where there was little support for what he termed "proactive enthusiasm" on the part of the police.

That view of the status quo fits with the reports which the consultant took away after his meeting with him, and which were then relayed to Mr Ogley via Mr Warcup.
