Sex offenders to get appeal right against register
Wednesday 16 February 2011
Thousands of sex offenders in England and Wales will be able to appeal against having their names on the sex offenders register for life.
The Government is introducing proposals to allow for appeals by all sex offenders, including paedophiles and rapists, following a decision by the Supreme Court last year. The case was started in 2008 by two convicted sex offenders who claimed that being on the register indefinitely with no right of review was in compatible with their rights to privacy.
They won their case in the High Court and the Supreme Court rejected a Home Office appeal. The President of the court, Lord Phillips, said it was obvious that there must be some circumstances in which an appropriate tribunal could reliably conclude that the risk of an individual carrying out a further sexual offence could be discounted.
One of the men at the heart of the case, known only as JF, was given a 30 month sentence for two counts of rape, committed when he was 11. Under the current rules anyone sentenced to at least 30 months in prison for a sexual offence is placed on the register for life.
They have to notify the police of their personal details, change of address and any travel abroad. The Scottish Government already allows adults to seek a review after 15 years on the register - and people convicted before they turn 18 can get a review after eight years.
The Home Office said that the proposals to allow appeals will be debated in Parliament, but there is no timetable for this at the moment.

Re: sex offenders to get right of appeal
Why is it disgusting?
A right of appeal is something that is necessary in all convictions. Look at how many innocent people have had convictions quashed after new evidence has come to light.

Re: sex offenders to get right of appeal
once a rapist or a peodophile always a rapist or peodophile...children have to be protected from these disgusting creatures ...they should have their bits cut off and be hung drawn and quartered imo...these animals should never ever walk among decent people and should have no right of appeal to being on the sex offenders list for life

Re: sex offenders to get right of appeal
What if they have been wrongly convicted, set up, framed or just been at the wrong place at the wrong time? Shouldn't they have a right of appeal?

Re: sex offenders to get right of appeal
Does that include people on the list for 'indecent exposure' when they were caught taking a leak up an alley whilst pissed? What about a 17 year old boy convicted of having consensual sex with a 15 year old girl?
I'm all for tight control of paedophiles and rapists but not everyone is on the list for such crimes.

Re: sex offenders to get right of appeal
Late last week, the Department of Justice and Homeland Security’s ICE office announced with great fanfare that they had seized a multitude of domains that were responsible for distributing counterfeit goods and child pornography over the Internet.
Seems pretty good, right? Unfortunately, over 84,000 of the sites grabbed by ICE had absolutely no link to child pornography or counterfeit goods at all. Nice one, guys.
Here’s what happened. As part of the absurdly titled “Operation Save Our Children,” ICE’s Cyber Crimes Center seized several high-level domain names they allege were distrubuting kiddy porn and illegal goods.
Unfortunately, one of those high-level domains was a free DNS provider… and host to over 84,000 websites. Consequently, those 84,000 domains were summarily shut down, their owners accused of child pornography crimes.
When afflicted site owners logged into their domains last Friday, this was the message that was waiting for them.
“Advertisement, distribution, transportation, receipt, and possession of child pornography constitute federal crimes that carry penalties for first time offenders of up to 30 years in federal prison, a $250,000 fine, forfeiture and restitution.”
The domain in question is called mooo.com, and is actually owned by DNS provider FreeDNS, one of the world’s most popular.
FreeDNS quickly reacted with a statement.
“Freedns.afraid.org has never allowed this type of abuse of its DNS service. We are working to get the issue sorted as quickly as possible,” they said on their website.
How did a mistake like this happen? It appears to be purely clerical, with mooo.com mistakenly placed on the list. The error was mistaken on Sunday, but not before visitors to over 84,000 websites were told that the owner of that site was a child pornographer… a rather slanderous mistake that might open the door for a federal lawsuit or two.

Re: sex offenders to get right of appeal
a 17 year old boy shouldnt be having sex with a 15 year old anyway ..it is against the law...think you will find peeing up an alley in guernsey is usually classed as breach of the peace.
